Terms and Conditions (AGB)
The General Terms and Conditions apply to all registrations and are acknowledged through the registration. We do not take responsibility for the accuracy of the data provided in the course program. The following AGB also contain statutory information regarding your rights under the regulations on contracts in distance selling and electronic commerce.
Scope of Application (1)
1.1. These General Terms and Conditions apply exclusively to the business relationship between Sprachschule DeutschCafé, owner: Gerelchuluun Chuluunbat, Grünwälderstr.20, 79098 Freiburg (hereinafter “Seller”) and the customer. The current version of the terms is valid at the time of ordering.

1.3. A consumer, according to these AGB, is any natural person who enters into a legal transaction for purposes that are not related to their commercial or independent professional activity (§ 13 BGB).
1.4. Deviating terms of the customer are not recognized unless the seller expressly agrees to them in writing.
Offers and Service Descriptions (2)
2.1. The presentation of courses on our website does not constitute a legally binding offer but an invitation to submit an order. Service descriptions in catalogs and on the seller’s websites are not considered warranties or guarantees.
2.2. All offers are valid as long as places in the courses are available. Errors are reserved.
2.3. Participants with 80% attendance are allowed to take the final test and will receive a certificate with grades upon successful completion. They will also receive a participation certificate with 80% attendance.
2.4. Participants who are absent from the exam without a valid excuse will not receive a certificate. Excused participants with a doctor’s certificate will have the opportunity to participate in a resit exam, which carries a 50 EUR participation fee. The participation in the regular exam within the intensive course is free of charge.
2.5. The certificate can be collected at the reception within 3 months after creation by prior appointment. After 3 months, a fee of 20 EUR will apply.
Registration (3)
3.1. Registration for a new course is possible at any time. Early booking is recommended, as courses are usually fully booked quickly.
3.2. The prerequisite for participation in courses is a minimum age of 18 years and proficiency in the Latin alphabet. Your registration becomes binding only after full payment of the course fee.
3.3. The announcement of events is subject to reservation. After registering for an event and receiving the registration confirmation, the contract is considered effective. You will receive a non-transferable registration confirmation. If you have not received this before the course begins, please inquire.
Invoicing (4)
After booking a course and confirmation from the school, you will receive an invoice. The invoiced amount is due for payment upon invoice issuance.
Participation Certificate / Attendance List (5)
A participation certificate will be issued after the completion of an event. The condition for this is participation in at least 80% of the classes. The attendance list serves as proof of regular attendance at events.
Minimum Number of Participants (6)
6.1. For the course to take place, the minimum number of participants must be reached before the course begins. If the required minimum number of participants is not met on the first course date, the course may be canceled. In this case, the course fee will be refunded.
6.2. If the course does not reach the required minimum number, it may still take place, considering content and organizational factors, if participants agree to pay a corresponding surcharge. The decision is made by the institute’s management.
Hikes and Study Trips (7)
For hikes and study trips, the respective regulations of the travel agency industry and service providers apply.
Special Conditions for Computer Use (8)
8.1. Use of Software: The programs made available during the course may not be altered, duplicated, distributed, or made publicly available in any way. Usage is only allowed for the purpose of course participation. Participants will be liable for any damages caused by violations.
8.2. Internet Access: If DeutschCafé provides internet access, it may only be used for course participation. Websites with pornographic, racist, or discriminatory content may not be accessed. Participants will be liable for any damages caused by violations.
8.3. Data Loss, Computer Viruses: Participants are responsible for backing up their data. DeutschCafé assumes no liability for data loss. DeutschCafé also assumes no liability for damage caused by the application of acquired knowledge or by the use of programs created or modified, or by computer viruses or other destructive programs.
Cancellation / Refunds (9)
9.1. Sprachschule DeutschCafé may withdraw from the contract due to low participation, cancellation of a teacher, or other valid reasons. In such cases, payments already made will be refunded. Further claims against Sprachschule DeutschCafé are excluded.
9.2. Cancellation by a participant must be made in writing no later than 30 working days before the course begins. Non-attendance at the course does not count as cancellation. In case of later cancellation, course fees will not be refunded. Cancellation due to illness must be confirmed by a medical certificate. Please contact the school management for such cases. The school management will review if a cancellation is possible. Discounts are void upon cancellation. Once a visa confirmation has been issued, confirmation of the visa denial is required for cancellation. A fee of 50 EUR applies in case of cancellation or chargebacks.
9.3. Cancellation declared to the instructor is ineffective.
9.4. In case of a business closure, courses will be conducted online or rescheduled. Cancellation is not possible in this case.
Copyright Protection (10)
10.1. For copyright reasons, photographing, filming, and recording in events are not allowed.
10.2. Teaching material may not be used, especially not duplicated, distributed, or publicly displayed without permission from Sprachschule DeutschCafé.
Liability (11)
The liability of Sprachschule DeutschCafé is limited to cases of gross negligence or intent on the part of Sprachschule DeutschCafé or its vicarious agents.
Duty to Mitigate Damages (12)
Participants are obliged to do everything reasonable to remedy any disruption or accident and minimize resulting damages.
Severability Clause (13)
Should individual provisions of these Terms and Conditions be wholly or partially invalid, this will not affect the validity of the remaining parts of the contract. The invalid provision or invalid part will be replaced by a regulation that corresponds to the presumed will of the parties or comes closest to it economically.
House Rules (14)
Sprachschule DeutschCafé is a guest in the buildings it uses. Please observe the house rules, refrain from smoking inside the building, and do not leave bicycles in the hallway. Religious, political, or commercial advertising during Sprachschule DeutschCafé events is not permitted.
Holidays and Public Holidays (15)
Unless otherwise specified or agreed, courses will not take place on public holidays or during most holiday periods. Changes are reserved. If classes fall on a public holiday, the full course fee is due, as well as in case of student absence.
Insurance (16)
Students are not insured by the school for health, accident, or liability. We recommend comprehensive insurance that also covers cancellation fees.
Data Protection (17)
The personal data provided by the participant to Sprachschule DeutschCafé will be processed and used electronically as far as necessary for the establishment, execution, or termination of the contract and customer service. The collection of personal data occurs exclusively for internal business purposes. Your data will be stored with us for 10 years. Information about age and gender is used exclusively for statistical purposes and better program planning. Data protection according to BDSG is observed. The personal data provided during registration is treated confidentially (§ 3 Abs. 1 BDSG). More information is available on our website under the privacy policy section.
Written Form (18)
Deviating agreements must be in writing. This also applies to the revocation of this requirement.
Storage of the Contract Text (19)
19.1. The seller stores the contract text of the order. The AGB are available online. The customer can print the contract text before submitting the order by using the print function of their browser.
19.2. The seller also sends the customer an order confirmation with all order details to the email address provided. The customer will also receive a copy of the AGB with their order.
Jurisdiction (20)
The place of performance is Freiburg. The place of jurisdiction for all disputes arising from the contractual relationship is also Freiburg, if the contracting parties are merchants.
Final Provision (21)
With the publication of these Terms and Conditions, all previous versions lose their validity.
